DC 37 Paid Family Leave

Beginning January 6, 2019, DOE employees in titles represented by DC 37 may be eligible to take up to ten weeks of DC 37 Paid Family Leave (PFL) under the New York State Paid Family Leave program.

Paid Family Leave provides job-protected, paid time off so you can:

  • Bond with a newly born, adopted or fostered child,
  • Care for a close relative with a serious health condition, or
  • Assist with family situations when a family member is deployed abroad on active military service.

Who Is Eligible?

To qualify for DC 37 PFL, you must be in a title represented by DC 37 and meet either of the following criteria by the date you would like to begin your leave:

  • Full-time employees who work a regular schedule of 20 hours or more per week are eligible for PFL after 26 consecutive weeks of employment, at any time since the most recent City start date, preceding the first full day of PFL. 
  • Part-time employees who work a regular schedule of less than 20 hours per week are eligible after working 175 days. The 175 days need not be consecutive, but must have been in a 52 consecutive week period preceding the first full day of PFL.

When Can I Use Paid Family Leave?

  1. To participate in providing care, including physical or psychological care, for a family member with a serious health condition
  2. To bond with your child:
    1. during the first 12 months after the child’s birth;
    2. during the first 12 months after the placement of the child for adoption or foster care; or
    3. before the actual placement or adoption of a child if an absence from work is required for the placement for adoption or foster care to proceed.
  3. Due to any qualifying exigency pursuant to FMLA, arising out of active duty or an impending call or order to active duty in the Armed Forces of the United States for your spouse, domestic partner, child or parent.

Benefit

If approved, you are eligible for up to 10 weeks of Paid Family Leave, which you can take continuously or intermittently in full day increments. During 2019, the benefit will be 55% of your average weekly wage (based on your last eight weeks of pay prior to starting the leave). The maximum weekly benefit is $746.41 per week. The benefit will be paid by AbSolve, the third party PFL insurance carrier, and you will not receive your NYCDOE wages for those days.  

The City will continue to provide your health insurance while you are on Paid Family Leave, regardless of your FMLA eligibility. You will still be responsible for any co-pays and/or employee contributions for health insurance.

How to take a Paid Family Leave

To apply for Paid Family Leave, use the Self-Service Online Leave Application System (SOLAS). The PFL application will open in SOLAS on January 10, 2019 and allow you to request leave of absence for dates beginning January 6, 2019 and onwards.

DOE employees should not apply using the forms on the New York State Paid Family Leave website. You must submit your application via SOLAS instead.

Complete your application in SOLAS at least 30 days before the leave is set to begin, if possible, but no more than 45 days in advance.  You should also notify your school/office of your intentions.

After you submit your application, if you are eligible for PFL, AbSolve will send you instructions on how to finalize your application, including:

AbSolve will then make a final determination on your PFL leave application.

Throughout this process you must communicate directly with your supervisor/school so they can plan for your absence.
